Case History

The first rent review on a relatively long lease was due on a 20,000,sq ft car showroom and workshop complex fronting a South London Trunk Road. Five years previously, Caxtons had arranged the letting to the retailing arm of a large motor manufacturer. At that time, the tenant substantially reconfigured and improved the property. Caxtons provided advice to its client on how to best protect its financial position and a gearing arrangement had been entered into.

It was particularly important to establish the best rent. The changes in the property since letting and the recession in the intervening period made the task particularly awkward.

Using its specialist skills in automotive property, Caxtons negotiated with the tenant's surveyor. The assumed condition of the property, the weight to be given to evidential transactions on other property and the merits of a large first floor used car sale deck were all important considerations. Due to difficulties in agreeing the new rent, an Arbitrator was appointed but following Calderbank offers by both parties, the new rent was finally settled at 15% increase. Working closely with our client throughout, it required 18 months of negotiations to reach agreement.
